The employed author’s labor rights: an analysis of the understanding of the labor courts

Despite the regulation provided by Law nº 9.279/96, which regulates the rights and obligations regarding industrial property, Law nº 9.610/98, about author's right, and Law nº 9.609/98, which provides for the protection of the intellectual property of computer programs, in the field of Labor Law there is still a debate over the employee's creations during the contract's length. The worker's protection, pursuant to the constitutional and infra-constitutional provisions, has been the fundament of some favorable decisions, in the area of Labor Justice, in the sense of conceding compensations to the invention's employed author.
