Industrial Property in Business: Legal Protection and Economic Exploitation of Intangible Assets

Industrial property acquires particular relevance to business activity when legally protected intangible assets become part of a company's economic and patrimonial organization. This essay analyzes the legal regimes applicable to inventions, utility models, industrial designs and trademarks in order to understand how their protection allows them to function as business assets. The study adopts a legal-dogmatic approach focused on Brazilian industrial property law. It argues that these rights perform a function that extends beyond granting exclusivity to their holders, since they also provide a legal framework for the protection, valuation and economic circulation of intangible assets. The analysis addresses the conditions governing patents and registrations, the administrative role of the Brazilian National Institute of Industrial Property and the use of licensing and assignment arrangements. It concludes that industrial property protection constitutes an important instrument for structuring intangible business assets and enabling their economic exploitation.
