Environmental disasters: an analysis from the perspective of legal action

The aim of this study was to analyze environmental disasters from the perspective of legal action and human rights. This is an exploratory observational study with data collection based on environmental catastrophes occurred in 2019 in Brazil. A documental analysis of the stable environment was made. To collect primary data on legal action in cases of environmental disasters, semi-structured questionnaires were used, collecting data from the Human Rights Commission of the Brazilian Bar Association, Arapiraca-AL Subsection. Regarding secondary data, electronic searches were made primarily on the website of the Ministry of the Environment. It concludes by stating that states should be the first to guarantee and preserve the rights of people affected by environmental disasters by sending resources and humanitarian aid to reduce the damage caused.
