Abstract

This article presents the alternative dispute resolution procedures adopted by the Intellectual Property Defence Centre of the Brazilian National Institute of Industrial Property, in cooperation with the Arbitration and Mediation Centre of the World Intellectual Property Organization, for handling trademark disputes. The paper describes the operation, on an experimental basis, of the Conflict Mediation Unit, and discusses the application of the legal instrument of mediation of industrial disputes, aimed at addressing conflicts in industrial property. It sets out the legal grounds that authorise mediation in the Brazilian legal order, examines the practice of the WIPO Arbitration and Mediation Centre and analyses the pilot project for trademark mediation implemented by the Centre since July 2013.
