Technological race and national security: a comparative analysis of the situation of Huawei and TikTok in Brazil and in the USA

This article seeks to elucidate the different legal and regulatory approaches regarding the operations of Huawei and TikTok, in the USA and in Brazil respectively. By analysing legislative and regulatory initiatives, judicial proceedings and other legal instruments concerning the activity of these companies in both countries, we aim to contribute to the national academic debate and to the work of legal practitioners and public policy makers on some of the risks presented by Chinese technology and communications companies. Bills, regulatory agency rules, provisional measures and executive orders are examined, as well as the United States litigation surrounding the proposed TikTok ban and the restrictions imposed on Huawei in the supply of fifth-generation infrastructure. At the end of the work, we point out which solutions Brazil may develop so that it can at the same time safeguard its national sovereignty without taking sides, in an increasingly tense and competitive technological geopolitical race.
