Doctrinal and jurisprudential analysis of intellectual property rights in the Brazilian Constitution

The objective of the article is to analyze the doctrine and jurisprudence regarding the importance of the constitutionalization of Intellectual Property Rights. It is a descriptive research, whose methodology used consists of bibliographic research, mainly in the legal areas of Constitutional Law and Intellectual Property Law, also using jurisprudential analysis. In the end, it is concluded that the Federal Constitution regulated the subject in article 5, items XXVII to XXIV, elevating Intellectual Property Rights to the status of Fundamental Right of the human being, being also a Personality Right.
