The effects of exclusive marketing rights on competition: notes on the relation between intellectual property and antitrust

Antitrust Law and Intellectual Property (IP) Law relate to each other in a complex way, since the protection guaranteed creates artificial monopolies as a reward for the creative efforts applied to a given invention, intending to promote innovation and technological development. For that reason, it is essential for Antitrust Law to take special care with IP, insofar as the granting of exclusivity rights without legal basis – especially due to problems in the registration of such rights – may cause substantial harm to competition. With Brazil's signature of the TRIPS Agreement, new institutes whose impact on competition is still little known were introduced into domestic law. It is the case of Exclusive Marketing Rights (EMR), a controversial instrument which has nevertheless been granted by Brazilian courts. Given the lack of a proper proceeding for granting EMR, this paper analyses the way by which this right is being developed in Brazil and in the international community, exploring the recent case law of the courts and of CADE.
