This article has as its main theme to present the existence of the compulsory licence of patents in case of national emergency or public interest, in conjunction with the principle of the social function of patents. In these terms we will present the existence, evolution, legislation and legal protection of patents, from their beginnings to their present force in Brazilian society. Later we will discuss their commercialization, differentiating the voluntary licence from the compulsory one, so that in the end we can point out ways and means for the Public Authority to give effect to the compulsory licence.
