The knowledge commons: concept, distinctions and analysis under the bundle of rights

This study, through a literature review, has as its main goal to examine the knowledge commons from the perspective of the bundle of rights through the presentation of two concepts of great relevance for the study of property rights: the traditional commons and the existence of a bundle of property rights over a given common-pool resource, and the knowledge commons. Before studying the knowledge commons from the perspective of the bundle of rights, and in order better to understand the peculiarities of each resource to be presented, this study will draw distinctions between the traditional commons and the knowledge commons. It will further emphasise the importance of governance structures to ensure the durability and sustainability of certain commons, so as to avoid the over-exploitation of a natural resource (Tragedy of the Commons) or the underutilisation of an intangible resource (Tragedy of the Anticommons). At the end of the study, a reflection is proposed on an analysis of the knowledge commons from the perspective of the bundle of rights.
