About the Journal

Focus and Scope

PIDCC publishes work examining the legal regime of intellectual property from its constitutional foundations and its compatibility with fundamental rights and human rights.

The journal's thematic core comprises:

  • the constitutional foundations of intellectual property and its social function;
  • the collision between exclusive rights and fundamental rights of access — to knowledge, health, education, culture and information;
  • patents, trademarks, industrial designs, geographical indications, plant varieties, trade secrets and copyright, in their doctrinal and critical dimensions;
  • intellectual property and development: technology transfer, innovation, university–industry relations and public policy on science and technology;
  • the challenges posed by new technologies, particularly artificial intelligence, biotechnology and the digital environment;
  • the international dimension of the field: TRIPS, WIPO treaties, comparative law and the asymmetries between developed and developing countries.

Work from cross-cutting fields is equally welcome — constitutional law, human rights, international law, business law, criminal law, philosophy of law, bioethics, economics and management — provided it engages with that core.

The journal publishes in Portuguese, English and Spanish.
