DA EXPECTATIVA DE DIREITOS DA MONSANTO NO BRASIL SOBRE OS PEDIDOS DE PATENTES DA “TECNOLOGIA” INTACTA RR2 PRO: ONDE ESTÁ DE FATO A INOVAÇÃO?

As patentes relativas à tecnologia RR1 que expiraram em 31/08/2010 ainda estão sendo objeto de questionamentos judiciais nos tribunais brasileiros, principalmente sobre pagamento indevido de royalties à Monsanto, bem como a discussão se a tecnologia envolvida é regulada por lei de patentes ou de cultivares. Neste ínterim a Monsanto apresentou novos documentos de registro de patentes para seguir cobrando royalties para a “nova” tecnologia conhecida comercialmente como Intacta RR2 PRO e que já se encontra no mercado brasileiro. A questão crucial no presente trabalho é analisar se a nova tecnologia RR2 da titular Monsanto pode ser equiparada a tecnologia anterior RR1 ante a seus efeitos jurídicos, legais e socioeconômicos, bem como o alcance da proteção conferida pelos diversos documentos reivindicatórios de patentes perante o órgão administrativo - INPI.

The RR1 technology-related patents that expired on 31/08/2010 are still being court challenges object in Brazilian courts, mainly on overpayment of royalties to Monsanto, and the discussion is the technology involved is regulated by patent law or cultivars. Meanwhile Monsanto submitted new patent registration documents to follow charging royalties for the "new" technology known commercially as Intact RR2 PRO and is already in the Brazilian market. The crucial question in this paper is to analyze whether the new RR2 technology Monsanto holder may be treated as prior art against the RR1 its legal, legal and socio-economic effects, and the scope of the protection conferred by the various patent documents vindicated before the administrative body - INPI.

Les brevets liés à la technologie RR1 qui a expiré le 31/08/2010 sont encore en cours contestations judiciaires se opposent dans les tribunaux brésiliens, principalement sur trop-perçu de redevances à Monsanto, et la discussion est la technologie utilisée est réglementée par la loi de brevet ou cultivars. Pendant ce temps Monsanto a soumis de nouveaux documents d'enregistrement de brevets à suivre redevances de charge pour la «nouvelle» technologie connue dans le commerce sous Intact RR2 PRO et est déjà sur le marché brésilien. La question cruciale dans ce document est d'analyser si la nouvelle technologie de RR2 Monsanto titulaire peut être considéré comme art antérieur contre le RR1 ses effets juridiques, juridiques et socio-économiques, et l'étendue de la protection conférée par les divers documents de brevet justifié devant l'organisme administratif - INPI.
