O DIREITO DO AUTOR SOBRE A EXPLORAÇÃO ECONÔMICA DA OBRA

RESUMO | ABSTRACT

Com os recentes avanços tecnológicos ocorridos nas últimas décadas, principalmente a partir da segunda metade da década de 1990, a Propriedade Intelectual como um todo, e o Direito Autoral em particular vivem, a maior ameaça que já sofreram nos últimos três séculos. A primeira grande ameaça foi com a imprensa de Gutenberg (século XV, entre 1445-1450), neutralizado no século XVIII, com o Copyright Act, da rainha Ana da Inglaterra, no ano de 1710, que limitou os privilégios de reprodução dos editores, atribuindo o direito de reprodução aos autores das obras intelectuais, constituindo-se, assim, num significativo avanço na proteção do direito autoral para a época e que foi seguido pelos demais países europeus como França, Alemanha, Dinamarca e Espanha;  a segunda grande ameaça ocorreu com a invenção das máquinas  de reprodução fotostática, mais conhecidas por máquinas Xerox, pelo norte-americano Chester Carlson em 1937, que se tornaram economicamente viáveis a partir de 1950 pela Xerox Co., daí também a denominação de xerografia. Passado quase meio século, parece que a ameaça novamente está de volta, desta vez, com o avanço da tecnologia digital e do computador que permitem cópias perfeitas, enquanto que a Internet sem fronteiras, favorece sua rápida disseminação, a um custo de distribuição relativamente baixo. Além, é claro, da facilidade e da rapidez em poder se distribuir e disponibilizar, em uma fração de segundos, uma obra digitalizada para centenas de milhares de pessoas, com um simples apertar de uma tecla de um computador interligado na rede mundial de computadores. Será que o direito autoral sobreviverá ao desafio da internet? Sem sombra de dúvida, essa e outras perguntas têm provocado inúmeros comentários de especialistas preocupados com a sobrevivência do direito autoral. Mas ao que nos parece, o direito autoral não está morto. A sua natureza jurídica resistiu a todas as intempéries e há de sobreviver também a essa.

With the recently technological advances occurred in the last decades – principally since the second half of the 1990s, the intellectual property as a whole and the copyright have experienced the strongest threat ever in the past three centuries. The first threat was Gutenberg’s printing press (XV century, between 1445-1450), neutralized in the XVIII century, with the queen Ana I of the Great-Britain’s Copyright Act, in 1710, that limited the editors’ privileges of reproduction, attributing the right to reproduction to the authors of the intellectual works; it turned to be a relevant advance in the protection of the copyright at that time, and the same thing happened in some European countries, such as France, Germany, Denmark and Spain. The second threat occurred with the invention of the machines of photo static reproduction, better known as Xerox copy machines, by the north-American Chester Carlson, in 1937, which became economically feasible in 1950 by Xerox Co.; that’s why the term xerography. Almost half a century later, it seems that the threat is already back; but this time, along with the advance of digital technology and of the computers - that give us perfect copies – the internet with no limits favors its fast dissemination, at a relatively low distribution cost. Besides, obviously, the facilities and fastness in distributing and availing, in a fraction of seconds, a digitalized work to hundreds of thousand of people, with a simple “press in the bottom” of a computer interconnected to the World Wide Web. Will the copyright survive the Internet? Doubtless, this and other questions have incited numberless of comments from specialists worried about the survival of the copyright. But, as far as we can see, the copyright is not dead. Its juridical natural has resisted to all bad times and for sure will survive this one too.
