RESUMO | ABSTRACT \ RÉSUMÉ

O desenvolvimento sociocultural propiciado pelo advento dos recursos tecnológicos de compartilhamento digital tem ampliado a capacidade de criação e difusão de informações. Assim, a inserção destes instrumentos e a adequação aos já existentes não poderia ficar inerte ao Direito, ao passo que o mesmo atua no sentido de regulamentar as relações entre os indivíduos em sociedade. No entanto, a taxatividade normativa interposta pela Lei nº 9.610/98 (LDA) ao direito do autor, acaba por ocasionar entraves à utilização do conhecimento e propagação cultural, demandando, por conseguinte, uma efetiva modernização.

The socio-cultural development brought about by the advent of digital sharing of technological resources has expanded the ability of creation and diffusion of information. Thus, the inclusion of these instruments and to adhere to its existing could not be inert to the law, whereas the same acts to regulate relations between individuals in society. However, the rules taxatividade filed by the Law No. 9.610 / 98 (LDA) of copyright, eventually causing barriers to the use of knowledge and cultural spread, requiring therefore an effective modernization.

Le développement socio-culturelle provoquée par l'avènement de partage numérique de ressources technologiques a élargi la capacité de création et de diffusion de l'information. Ainsi, l'inclusion de ces instruments et à adhérer à sa existant ne pouvait pas être inerte dans la loi, alors que les mêmes actes pour réglementer les relations entre les individus dans la société. Toutefois, les règles taxatividade déposées par la loi n ° 9.610 / 98 (ISC) du droit d'auteur, causant des obstacles à l'utilisation des connaissances et la diffusion culturelle, nécessitant donc un la modernisation efficace.
