RESUMO | ABSTRACT
With the recently technological advances occurred in the last decades – principally since the second half of the 1990s, the intellectual property as a whole and the copyright have experienced the strongest threat ever in the past three centuries. The first threat was Gutenberg’s printing press (XV century, between 1445-1450), neutralized in the XVIII century, with the queen Ana I of the Great-Britain’s Copyright Act, in 1710, that limited the editors’ privileges of reproduction, attributing the right to reproduction to the authors of the intellectual works; it turned to be a relevant advance in the protection of the copyright at that time, and the same thing happened in some European countries, such as France, Germany, Denmark and Spain. The second threat occurred with the invention of the machines of photo static reproduction, better known as Xerox copy machines, by the north-American Chester Carlson, in 1937, which became economically feasible in 1950 by Xerox Co.; that’s why the term xerography. Almost half a century later, it seems that the threat is already back; but this time, along with the advance of digital technology and of the computers - that give us perfect copies – the internet with no limits favors its fast dissemination, at a relatively low distribution cost. Besides, obviously, the facilities and fastness in distributing and availing, in a fraction of seconds, a digitalized work to hundreds of thousand of people, with a simple “press in the bottom” of a computer interconnected to the World Wide Web. Will the copyright survive the Internet? Doubtless, this and other questions have incited numberless of comments from specialists worried about the survival of the copyright. But, as far as we can see, the copyright is not dead. Its juridical natural has resisted to all bad times and for sure will survive this one too.
